Categories: Judges

Elena Nikolaevna Shilko personally takes direct part in politically motivated repressions in the Republic of Belarus, the consequence of which is, among other things, the death of people persecuted by the current regime. Shilko has been delivering convictions in political cases since at least 2006. Considers complaints about unlawful decisions of his colleagues, leaving them in force. Conducts closed hearings. She sentenced Ales Pushkin to 5 years in prison under two articles of the Criminal Code: under Part 3 of Art. 130 (deliberate actions to rehabilitate Nazism, committed by a group of persons) and Art. 370 (desecration of state symbols). This case has completely politically motivated implications, since Ales was an opponent of Lukashenko’s regime and directly expressed his civic position. On July 11, 2023, Ales died in intensive care under unknown circumstances. Taking into account the fact that Ales was illegally convicted and subsequently died while serving his prison term, there is reason to assert that this employee is directly related to this death. In 2011, Shilko sentenced Young Front activists Dashkevich and Lobov. The young people were detained in Minsk on December 18, 2010. According to information from the Central Internal Affairs Directorate of the Minsk City Executive Committee, in the courtyard of a residential building on Yanka Bryl Street they allegedly beat Konstantin Savitsky and Oleg Malyshev. Representatives of the opposition and human rights activists regarded the detention of Dashkevich and Lobov as a preventive measure by the police on the eve of the elections. Dashkevich was sentenced to two years in prison in a general regime colony, Lobov - to four years in a maximum security colony. Convicted Dmitry Doronin, Sergei Kazakov, Vladimir Loban, Vitaly Matsukevich, Evgeniy Sekret and Oleg Fedorkevich, who were accused under Part 2 of Article 293 “Participation in mass riots.” Shilko sentenced everyone to 3-3.5 years in prison. Elena Shilko convicted political prisoner student Artem Boyarsky under Article 342 of the Criminal Code - Organization and preparation of actions that grossly violate public order, or active participation in them, and Article 361-1 of the Criminal Code - Creation of an extremist formation or participation in it. The young man was severely beaten during his arrest. Also, a video appeared on Azarenka’s Telegram channel in which Artem admits to administering a public page recognized as extremist. To force him to say this on video, the guy was beaten with batons on his back and buttocks. Artem told his lawyer this during interrogation. Shilko sentenced him to five years in prison under enhanced security conditions. She sentenced political prisoner Mia Mitkevich to three years in a general regime colony for comments about the situation in the country. She convicted political prisoner Ivan Cherevako and sentenced him to 4 years in prison. Thus, Elena Nikolaevna Shilko is responsible for human rights violations and undermining the principles of the rule of law, as well as for promoting repression against representatives of civil society and the democratic opposition, which also results in the death of people persecuted by the regime. Her work within the judiciary is focused on maintaining the position of the existing government, rather than on enforcing the law. Shilko’s actions contribute to human rights violations, strengthening the power of Alexander Lukashenko and increasing politically motivated repression in the Republic of Belarus.

Alexander, an activist and well-known Belarusian artist, was arrested in late March 2021 on charges of “rehabilitating Nazism” after he displayed a portrait of Yevgeny Zhikhar with a machine gun over his shoulder at an exhibition at the Grodno City Life Center. The prosecutor’s office claimed that Alexander “characterized Zhikhar as a fighter against the Bolsheviks, glorifying his actions.” Despite the threat of prosecution, Alexander did not cancel his return to Belarus from Ukraine, where his exhibition was taking place.

On March 25, 2022, during the trial, he cut his stomach in protest, for which he received 13 days in solitary confinement. He was later convicted of "inciting hatred or discord" and "desecration of state symbols." The political prisoner refused to file an appeal.

As it became known, in November 2022, Alexander's type of punishment was toughened and he was transferred to prison regime.
