According to the prosecution , in August 2020, Vasilenko, while on Pobediteley Avenue, noticed a crowd of citizens, including those with various protest paraphernalia. Together with them, as well as with an acquaintance, he walked to Independence Avenue, while moving along the sidewalk. In one place I went out onto the roadway to take a photo with a white-red-white flag. It was this photo that served as the reason for his arrest and charges.

During the trial, episodes about Konstantin publicly shouting slogans were excluded from the charges. The court also excluded the property claims of the Minsktrans enterprise, since Vasilenko’s actions did not interfere with the operation of public transport.
